1. Acceptance
By accessing or using Gentle Push (the “Service”), you agree to be bound by these Terms of Use. If you do not agree, please stop using the Service immediately. These terms apply to all visitors, registered users, and anyone who uses the platform in any capacity.
2. What the Service Does
Gentle Push provides a free push notification platform for communities, clubs, and organisations. The Service allows you to collect browser push subscriptions from your community and send notifications to them via web push, Apple Push Notification service (APNs), and transactional email (SMTP). We will always offer a free tier to communities.
3. Acceptable Use
You agree to use the Service only for lawful purposes and in a way that does not infringe the rights of others. Specifically, you must not:
- Send spam, unsolicited commercial messages, or bulk promotional content to people who have not opted in to your list.
- Send content that is illegal, harmful, threatening, abusive, harassing, tortious, defamatory, or otherwise objectionable.
- Use the Service to distribute malware, phishing links, or any code intended to damage or gain unauthorised access to systems.
- Impersonate another person or organisation in your notifications.
- Attempt to reverse-engineer, scrape, or abuse the API beyond normal usage.
We reserve the right to suspend or terminate accounts that violate these rules, with or without notice.
4. API Keys & Account Security
Your API key is a secret credential that authenticates requests to the Gentle Push API. You are responsible for keeping it secure. Do not share your API key in public repositories, client-side code, or any publicly accessible location. If you believe your key has been compromised, rotate it immediately from the dashboard Settings page.
You are responsible for all activity that occurs under your account, whether or not you authorised it.
5. Subscriptions (Organisation Tier)
The Organisation tier is a paid optional upgrade processed via Stripe. By subscribing you authorise us to charge your payment method on a recurring monthly basis. You may cancel at any time through the billing portal; access continues until the end of the paid period. Refunds are issued at our discretion for genuine billing errors.
6. Intellectual Property
The Gentle Push platform, its logo, and all associated software remain the property of the Gentle Push team. You retain full ownership of the content you send (notification titles, bodies, icons) and your subscriber list. We do not claim any rights over your community’s data.
7. Availability & No Warranty
The Service is provided on a best-effort basis. We do not guarantee 100% uptime, error-free delivery, or that notifications will always reach their intended recipients. Push delivery depends on third-party systems (browser vendors, Apple, SMTP relays) that are outside our control.
The Service is provided “as is”, without warranty of any kind, express or implied. Use of the Service is at your own risk.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Gentle Push and its contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, the Service — even if advised of the possibility of such damages.
9. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. Material changes will be announced via a dashboard notification. Continued use of the Service after changes take effect constitutes your acceptance.
10. Governing Law
These Terms are governed by the laws of Ireland, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ireland.
